02

Nature of the Site and business transactions

The Site provides corporate information and advertises our capabilities, products and services. Unless a particular feature expressly states otherwise, the Site is not an online checkout platform and does not by itself conclude a sale, appointment or other transaction.

Site content is general information only. It is not a binding offer, engineering or safety advice, certification, specification, warranty or contractual commitment. A request for information, enquiry, registration of interest or submission through the Site does not oblige either party to enter into a transaction.

03

Permission to use the Site

We grant you a limited, non-exclusive, non-transferable and revocable permission to access and use the Site for lawful personal use or internal business evaluation. This permission does not transfer ownership of any Site content or intellectual property.

04

Acceptable use

You must not, and must not assist another person to:

  • use the Site for an unlawful, fraudulent, misleading, abusive or harmful purpose;
  • gain or attempt to gain unauthorised access to the Site, another account, a server, network, system or data;
  • introduce malware or other harmful code, interfere with Site operation, bypass security measures, or impose an unreasonable load on our systems;
  • scrape, harvest or collect information through automated means except through ordinary search-engine indexing or with our prior written permission;
  • impersonate another person, misrepresent an affiliation, or submit information that is false, defamatory or infringes another person's rights;
  • remove proprietary notices, copy the Site to build a competing service, or commercially exploit Site content without permission; or
  • use our name, logo or content in a manner that suggests sponsorship, endorsement or association that we have not approved.
05

Intellectual property

The Site and its text, graphics, photographs, videos, drawings, documents, page design, software, trade names, trademarks, logos and other content are owned by or licensed to us and are protected by applicable intellectual-property laws.

You may view, print or download a reasonable portion of the Site solely for personal reference or internal evaluation of a potential business relationship, provided all copyright and proprietary notices are retained. No other reproduction, adaptation, distribution, publication, public display, framing, sale, licensing or commercial use is permitted without the relevant rights holder's prior written consent.

06

Intellectual-property complaints

If you reasonably believe that material on the Site infringes your intellectual-property rights, please email general@padusedia.com.my with:

  • your name and contact details;
  • identification of the protected work or right;
  • the Site location of the material concerned;
  • an explanation of the alleged infringement and your authority to act; and
  • supporting information reasonably needed for us to assess the notice.

We may remove or restrict access to material while we assess a complaint and may request additional information. You are responsible for ensuring that a complaint is accurate and made in good faith.

07

Enquiries, submissions and communications

Information you submit must be accurate, lawful and appropriate for the stated purpose. Do not send passwords, payment-card information, highly sensitive personal data, export-controlled information or confidential technical or commercial material through a general website form or ordinary email unless we specifically request it and provide an appropriate method.

08

Accuracy and changes to Site content

We take reasonable care when preparing Site content, but specifications, photographs, availability, project descriptions and other information may be incomplete, out of date or subject to change. You should obtain current written confirmation before relying on information for an enquiry, design, safety, operational or investment decision.

We may correct, update, remove or reorganise Site content at any time. A Site update does not amend an existing signed contract unless the parties agree in writing.

09

Third-party websites and content

The Site may link to third-party websites, platforms or materials for convenience. We do not control them and do not necessarily endorse or warrant their content, availability, security or privacy practices. Your use of a third-party service is governed by its own terms and policies.

10

Availability and security

We may maintain, suspend, restrict, change or withdraw all or part of the Site without notice. We do not guarantee uninterrupted or error-free availability, compatibility with every device, or that the Site will always be free from harmful components. You should use appropriate security controls, current software and independent backups.

11

Disclaimer of warranties

To the maximum extent permitted by law, the Site is provided on an "as is" and "as available" basis. We disclaim warranties and representations not expressly stated in these Terms, including implied warranties relating to accuracy, completeness, satisfactory quality, fitness for a particular purpose and non-infringement. This clause does not affect a warranty or statutory guarantee that cannot lawfully be excluded.

12

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, exemplary or consequential loss, loss of profit, revenue, opportunity, goodwill, anticipated savings or data arising solely from your access to, inability to access, or reliance on the Site.

Nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation, willful misconduct or personal injury caused by negligence, breach of a non-excludable statutory guarantee, or any other liability that cannot lawfully be excluded or limited. Liability relating to an actual supply or project is governed by the relevant transaction contract and applicable law.

13

Privacy and cookies

Our Personal Data Protection and Privacy Notice explains how we collect, use, disclose, protect, retain and transfer personal data, and how cookies and similar technologies may be used on the Site. Please read that notice together with these Terms.

Read the Website Privacy Policy

14

Suspension or termination

We may restrict or terminate access where reasonably necessary to protect the Site, users, our rights or another person; to investigate suspected misuse; or to comply with law. Clauses that by their nature are intended to continue, including intellectual property, disclaimers, liability and governing law, survive termination.

15

Changes to these Terms

We may update these Terms to reflect changes in law, the Site or our practices. The revised Terms take effect when posted with a new "Last updated" date, unless a later date is stated. Continued use after the effective date constitutes acceptance of the revised Terms; if you do not agree, discontinue use. Changes to these Terms do not retrospectively amend an existing written contract.

16

General

If any provision is unlawful or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue. A delay or failure to enforce a right is not a waiver. These Terms and any notices expressly incorporated into them constitute the agreement concerning use of the Site, but do not replace a transaction-specific contract. Headings are for convenience only.
